The rules for using our sites, written to be read.
Effective date: October 10, 2026. Last updated: October 10, 2026.
These Terms of Service (“Terms”) are an agreement between you and SaleFans LLC (“SaleFans”, “we”, “us”, or “our”). SaleFans LLC operates GarageSaleFans.com and EstateSaleFans.com. These Terms cover your use of EstateSaleFans: browsing it, creating an account, saving sales and planning routes, listing a sale, asking to take over a listing, creating or managing a company profile, and sending an inquiry to a company.
Part I applies on both of our sites. Part II has the terms that apply only on EstateSaleFans. The terms that apply only on GarageSaleFans are shown on GarageSaleFans. By using EstateSaleFans, or by continuing where these Terms are presented to you, you agree to them. If you do not agree, please do not use EstateSaleFans.
Our Privacy Policy explains how we handle personal information. It is a separate document.
EstateSaleFans helps people find estate sales, downsizing sales, and other household sales and plan a trip to them. You can browse and search sales, save them, mark them Must Go, Maybe, Skip, or Visited, and plan a route with a suggested order and estimated times. Sellers list sales with photos and highlighted items, and may show prices for items. Sale pages have a “Report this listing” action for telling us something is wrong. EstateSaleFans also has profiles for estate sale companies, and lets you send an inquiry to a company.
SaleFans provides listing, discovery, and planning tools. We do not organize, operate, staff, supervise, or inspect the in-person sales listed on our Services.
SaleFans does not buy or sell the merchandise shown in listings, and is not a party to any sale between shoppers and sellers. There is no online checkout for merchandise. We do not collect payment for merchandise, take ownership of it, ship it, or deliver it. We do not guarantee payment or delivery, we do not handle returns or refunds for merchandise.
Shoppers and sellers deal with each other directly, and resolve any problem with a purchase between themselves.
Sellers choose and are responsible for the items offered at their sales, subject to applicable law and our rules. Sellers are responsible for every item they offer, whether or not the item appears in a listing. SaleFans does not take possession of, inspect, authenticate, or appraise items offered at a sale.
SaleFans does not guarantee that any item is genuine, lawful, safe, accurately described, or available.
Listings are provided by sellers. We do not guarantee that every listing is accurate, complete, current, authentic, or that a sale or item will be available as described. Sellers are responsible for the listings they publish. If you believe a listing is inaccurate, fraudulent, unsafe, or violates our rules, please use Report this listing.
When you list a sale, you confirm that:
Keep your listing up to date, and mark your sale canceled or closed early if your plans change.
We may ask a seller for information or documents showing that an item or a sale follows the law and our rules.
You choose when the exact street address of your sale appears: as soon as your listing is published, or later, about 24 hours before the sale opens, or about 3 hours before it opens on its first day. Until then, shoppers see only the town and a general area. By publishing an address, you confirm that you are allowed to publish it. An address you put in a photo or in the description is visible right away, whatever timing you chose. The reveal happens automatically and may not be exact to the minute.
You may not use our Services to advertise or promote a sale at which counterfeit goods, stolen goods, protected wildlife products, or other items that are unlawful to sell where the sale takes place are offered, whether or not those items appear in the listing.
You may not advertise, describe, picture, or highlight any of the following in a listing, including in its photos, its description, and its highlighted items:
You may not list counterfeit goods or replicas, reproductions, or imitations that are represented or presented as genuine or authentic.
Estate sales and other household sales sometimes include items like these, and selling some of them in person may be lawful where you are. Even so, they may not be advertised or pictured on our sites. You also may not list anything whose advertising or sale is against the law, or make false or fraudulent claims about an item.
When you use our sites, you may not:
These rules do not stop you from giving honest, lawful criticism.
You keep ownership of the photos, text, and other content you post (“your content”). You give SaleFans a non-exclusive, worldwide, royalty-free license to host, store, copy, resize, format, transmit, display, and otherwise process your content as reasonably needed to run our sites: to show your listings and profiles; to provide search, saved sales, routes, and the features that connect our two sites; to deliver information you ask for; and to keep our sites secure and working. Our service providers may do this for us. This license does not transfer ownership of your content to us.
When you delete your content, or it is removed under these Terms, it stops being shown on our sites. Copies may remain for a limited time in backups, logs, and security records, as our Privacy Policy explains. We cannot remove copies that other people made, such as screenshots.
Our sites, including their design, text, graphics, logos, and software, belong to SaleFans or its licensors. We give you a limited, personal, revocable, non-transferable right to use our sites under these Terms. You may not copy, sell, or reverse engineer our sites or their software, except where the law allows it.
Max™ is the mascot of SaleFans. Max, his name and his pictures, and the SaleFans™, GarageSaleFans™ and EstateSaleFans™ names and logos, are trademarks of SaleFans or its licensors. Please do not copy or use them without our written permission.
A route’s suggested order, travel times, and arrival times are estimates we calculate ourselves. They do not account for traffic, parking, accessibility, or whether a sale is still running. Directions open in a separate map service, such as Google Maps. Directions require a revealed address. Obey traffic laws, and do not use our sites in a way that distracts you while driving.
Sales happen in person, often at private homes. Going to one involves ordinary risks: travel, private property, strangers, used merchandise, and conditions at the site. Use good judgment, and follow the rules the seller sets.
You are responsible for deciding whether and how to attend a sale. SaleFans does not control conditions at sale locations or the conduct of sellers, shoppers, property owners, or other third parties.
Examine items before you buy. If you believe a sale involves counterfeit, stolen, prohibited, or unlawfully offered items, use Report this listing.
Reports go privately to our moderation team, and people review them. We do not promise any particular outcome.
We may investigate, restrict, hide, or remove a listing, and may suspend or terminate an account, with or without prior notice, including when we receive a report or reasonably believe our rules or applicable law may have been violated.
We are not required to monitor content, and reviewing or moderating something does not make us responsible for it.
We may keep relevant records and cooperate with rights holders and with lawful requests from government authorities.
Our team may add a listing or a company profile from information that is publicly available, so that shoppers can find it. Something our team added may say so. That does not mean we run, organize, own, or endorse the sale or the business.
If you run a sale or a business our team added, you can ask to take it over with the “Is this your sale?” or “Claim this business” button on its page. An administrator reviews each request and decides. Approval is not automatic, and we may ask for information to confirm your connection. By asking, you confirm that you are authorized to manage it. An approved claim moves the management of it to you. It does not transfer any intellectual-property rights.
EstateSaleFans is in a free beta. Listing a sale is free during beta, and EstateSaleFans sells no paid promotional upgrade. Nothing on this site charges you.
We will give at least 30 days' notice before any price starts.
If we offer a paid feature later, we show you its price and its terms before you pay, and a separate payment processor handles the payment. A paid feature is between you and SaleFans. It is separate from paying a seller for merchandise, which is always between you and the seller.
Some features rely on other companies. Clerk runs sign-in. OpenStreetMap provides map images and some place lookups. The U.S. Census Bureau checks sale addresses. Google Maps opens directions if you choose it. Those services have their own terms and privacy policies. We do not control them, and we do not guarantee them.
Our Privacy Policy explains what personal information we collect and how we use and share it. Send questions and requests to Privacy@SaleFans.com.
We respect intellectual property and expect our users to do the same. If you believe content on our sites infringes a copyright you own, or are authorized to act for, send a notice to our copyright contact at Legal@SaleFans.com. Under the Digital Millennium Copyright Act, your notice must include:
If we remove or disable material because of a notice, we take reasonable steps to tell the person who posted it promptly. If you believe your material was removed or disabled by mistake or misidentification, you may send a counter-notice to the same address. It must include:
When we receive a valid counter-notice, we promptly send a copy of it to the person who sent the original notice and tell them that we will restore the material in 10 business days. We then restore it not less than 10 and not more than 14 business days after we received the counter-notice, unless that person first tells us they have filed a court action seeking to stop the claimed infringement, as 17 U.S.C. § 512(g) provides. Anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f).
Repeat infringers. We may remove content that we believe infringes, and in appropriate circumstances we close the accounts of users who repeatedly infringe the intellectual property of others.
If an intimate image of you was published on our sites without your consent, including an image made or altered by software to look like you, we will remove it. You, or someone you have authorized to act for you, can ask us by email at Legal@SaleFans.com. You do not need an account.
Please include:
When we receive a valid request, we remove the image as soon as possible, and no later than 48 hours after we receive it. We also make reasonable efforts to find and remove known identical copies on our sites.
We may add, change, or remove features at any time. We do not promise that our sites will always be available or free of errors.
Our sites are provided “as is” and “as available”. To the fullest extent the law allows, SaleFans makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not guarantee:
Some places do not allow some of these disclaimers. If a law gives you rights that cannot be waived, this section does not take them away.
To the fullest extent the law allows, SaleFans is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill. We are also not liable for sales we do not run, for merchandise, for the conduct of other users, for inaccurate listings, for maps, sign-in, or other services run by other companies, for transactions between shoppers and sellers, or for copies of content made by others.
SaleFans’s total liability for all claims relating to our sites or these Terms is limited to the greater of $100 or the amount you paid to SaleFans LLC in the 12 months before the claim arose.
These limits apply only as far as the law allows. They do not limit any liability that cannot legally be limited or excluded.
To the extent the law allows, you agree to defend, indemnify, and hold harmless SaleFans and its members, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, that come from:
We may take control of the defense of a claim you must indemnify, and you agree to cooperate with us. You may not settle such a claim in a way that binds SaleFans without our written consent. This section does not make you responsible for our own conduct where the law does not allow it.
An estate sale company can have a profile on EstateSaleFans. If you create or manage a profile, you confirm that you are authorized to act for the company, and that the profile’s information is accurate and kept up to date. The phone number and website on a profile are shown publicly as business contact information. We may remove, correct, or suspend a profile that breaks these Terms or that we believe is inaccurate.
“Save This Company” keeps a company in your saved list, like a bookmark. Saving a company does not subscribe you to notifications from that company, and it does not cause EstateSaleFans to send you company notifications.
A verified badge means only that our team reviewed the company’s identity and business details when we granted it. It is not an endorsement, and it is not a guarantee of the company’s work, statements, merchandise, service quality, or safety. We may decline a request for verification, and we may remove a badge.
Some companies accept inquiries through their profile. When you send one, you ask us to pass it to that company, and you agree that the company may contact you about it. We do not guarantee that a company will respond. Sending an inquiry is not permission for the company, or for us, to send you unrelated marketing. The company is responsible for how it handles your inquiry.
GarageSaleFans, our sister site, lets its shoppers see public EstateSaleFans sales among their results. Those cards show the same public information and link back to EstateSaleFans, and GarageSaleFans shoppers can save them and add them to their routes there. Your sale stays an EstateSaleFans listing.
Deactivating your EstateSaleFans account ends your access to EstateSaleFans and takes listings you own off the site. It does not erase your records. To ask us to erase them, email Support@EstateSaleFans.com or Privacy@SaleFans.com.
These Terms are governed by the laws of the State of Ohio and by applicable federal law, without regard to conflict-of-law rules. This does not take away any protection that the consumer laws of the place where you live give you and that cannot be waived by agreement.
Talk to us first. If you have a dispute with us, please email Legal@SaleFans.com first. Describe the problem and what you would like us to do. We will try to resolve it informally, and we ask that you give us 30 days to do so before you start a court case. Before we bring a claim against you, we will do the same, using the email address on your account.
Courts. A dispute that is not resolved informally will be decided in the state or federal courts located in Ohio, and you and SaleFans consent to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction over it. If the law where you live gives you a right to bring a claim in your local courts that cannot be waived, this section does not take that right away.
Nothing in this section stops either of us from asking a court for urgent relief, for example to stop the misuse of intellectual property or a threat to the security of our sites.
When we change these Terms, we update the “Last updated” date at the top. If a change is material, we give notice on our sites, and by email where the law requires it. Where the law requires advance notice, we give it at least 30 days before the change takes effect. Changes apply going forward only: they do not change the Terms that applied to anything that happened before. If you do not agree to a change, stop using our sites before it takes effect.
You may stop using our sites at any time, and you can deactivate your EstateSaleFans account in My Account. Sections that by their nature should last, such as “Your content”, “Disclaimer”, “Limitation of liability”, “Indemnity”, and this Part III, continue after your use ends.
